Seat height adjuster not locking into place

Hi, i was wondering if someone could help me with an issue im having with some seats i have just bought
There from a polo GTi so have height adjustability
but for some reason the drivers side seems to move (in height) even when the handle is not being pushed
the seat doesnt move if you sit on it.. but if you put the slightist pressure towards the back of the seat it will lower in height.. you can hear it lowering teeth by teeth on the adjusting mechanism
and if you get off the seat it will go to its highest position and pretty quickly.. once again u can hear the metal on metal clicks as it goes up the adjusting mechanism
if u sit on the seat and push down on the handle... the seat will stay in place
i thought it was the spring that may have been allowing the handle to move but ive swapped it for a working one and no luck
i thought id be as clear as possible
any help would be appreciated
