thinking of buying some Black Diamond discs etc????
You may want to read this first.
To try cut a long story short. i received some brake discs recently from Black Diamond. I open the outer box to find another smaller box damaged as the discs must have slided and impacted something in transit.
I was asked to send photos of my findings. After which i was told there was no evidence of damage to the discs, and they would not offer an exchange. but they would if i sent them back at my own expense and only if they found indeed there was damage, and then based on their word alone, and only then would they refund me courier costs which would be appox £25. Unbelievable.
I was then given the phone number for Chris the Managing Director (i believe). Who never made any apology, but infact just tried to make me feel i was doing something wrong, by making a complaint. All he said is the disc's are safe to use, and shouldn't be making a fuss. WTF!!!
Why would i put them on my car. if their is just the slightest chance they were not perfect.
After much heated arguments. I have been offered a replacement but still under my own expense in courier charges. Why would I give that arrogant cock my money??? I am now demanding a refund.

I can see your prob here, you don't know what caused the damage, how the box was impacted? by what? so you have no idea if the discs are cracked, warped etc (at worst case). If the box was badly damaged I would also be unhappy to put them on my car, the courier/post office are supposed to handle packages etc appropriately. However, goods you have bought should be in a satisfactory condition, defect free and fit for the purpose they were intended when you receive them. Can you see any defects? If you cannot see any damage when you look at the discs then Black Diamond are under no obligation to give a refund. Having said that, if they are damaged, you are entitled to a FULL refund, "that is the law" (in the voice of sylvester stallone AKA Judge Dredd). Did you pay by credit card as the C/Card company becomes equally responsible if the goods are faulty. If you get no joy, then it's the CAB or Small claims court. I'm not sure if you would be entitled to an exchange/refund if its the packaging that's damaged and there is no visible damage to the disks, you would need to check that one out.

did you buy them over the phone/internet? If you did then you have the protection of the distance selling regulations 2000. These basically say any transactions that take place where you dont have the opportunity to inspect the goods before purchase, you have 7 days to reject the goods whether there is any problem with them or not. It means within 7 days of delivery you have the right to send them back even if its because you dont like them or changed your mind. If they give you hassle just ring your local trading standards and they will give you further advice.
I can see both sides of the argument as we ship out 100's of items a week. It is sometimes difficult to tell the difference between a genuine error, or someone trying to fish for some discount off future products.
When you received the goods, did they have to be signed for, and did you sign for them, as the signiture on paperwork like that normally says that if you sign for them, you are signing for them as received in good/satisfactory condition, hence why he will be such an ar5e about replacing them. However if they have not been signed for and delivered by royal mail etc I can understand your case entirely.

I'd ask your neighbour to make sure, but either way it should show him that you..the buyer have not signed for them...they should be able to bring up a p.o.d. (proof of delivery) to show who's signiture it was...at least you can say to him that if they were damaged in this way and you havent signed for them then it is down to his courier company's insurance to pay him back and cover the cost of re-shipping, however this does get more complicated if you neighbour did sign for them in good condition.
