Goddamn POLICE!!!!!
Been along time since i been on here, maybe 3 - 4 months ahhh well i been so busy, new job and stuff.
Anyways to the subject, was driivng thru Charlton while at work yesterday afternoon near the junction that leads to the A2, Police car behind me, traffic lights where just changing from Amber to Red, i swear to god when i did look they where amber, so i went thru, the police car followed me, pulled me over and procceded in giving me a ticket for jumping a red light, im so annoyed, cos thats 3 points and a £60 fine which i dont want at all,
I was thinkin of takin it to court and makin a complaint about the 2 officers that dealt with me, anyone had this happen to them and have taken it to court?
Any sort of advice would be welcome......

Your only excuse for going thro on Amber is that it would not have been safe to stop..... hint!!
Err and I think if you went thro on amber then they went thro on red!!!

You're actually supposed to stop on an amber light... unless its not safe to do so.
Which means if the car following you is following too closely... I'd try to explain I didnt slow down in time so I didnt want to slam on the brakes uncontrollably, but that wouldnt be sufficient reasoning.
This was the thinking I used to have when I jumped amber lights... but then I thought I've been lucky to jump this many.... next time I could get busted or even worse end up in a crash.
But back to the argument, you could claim that the police car following you was very close and you felt that you couldnt stop in time safely with the pigs following sooo close.

Re: Goddamn POLICE!!!!!
It wasn't too close behind me, but i guess maybe i can use that excuse, ive phoned there local station to make a complaint about them.
Its not like it turned red and i jus speed straight thru, i mean who the hell is gonna go thru a red light with a police car behind them?
Yes ur correct, i pointed out to him that he went thru the red light not me and he said in a cocky tone "Shall I write myself a ticket then?"
Goddamn P****s
Anyway shall i also mention that this is the 6th, yes 6th time i've been pulled over for somethin or other in the last wait for it.........

If you accepted the fixed penalty ticket i have a feeling you are already screwed but it's a while since i've been in this subject area
When I was stopped for Aledgedly jumping a red light - I refused the fixed penalty and told the officers concerned I would see them in court
Magistrates slept thro the case - I was convicted but a crown court I got a judge that listened - conviction was overtuned and case dismissed
In between magistrates and crown court I had put in a complaint of purjury against both police officers cos one or other (actually both) lied at the magistrates court
Don't go to court to try and get the case dropped - write letters now to cheif constable explaining the situation.
Be polite
Be factual
Explain the circumstances and how in a split second judgement you felt it would have been dangerous due to the close proximity of the car behind
Be careful not to critisise the officers involved but do point out wouldn't it have been rather daft to jump a red light with a police car behind you

I think with your attitude and no offence here you are going to crash and burn on the compaint front.......Silva_B!tch_Owner wrote:It wasn't too close behind me, but i guess maybe i can use that excuse, ive phoned there local station to make a complaint about them.

3 WEEKS
- Calm down first.
Write it all down clearly and consisely from start to finish including what was said
Sign it date it and get anyone to sign and date it too
This will be admissible in court and would be regarded as good evidence provided it was done as soon as possible after the incident - I'm not going to suggest you date and time it for as soon as possible after the incident happened but for when you actually did it......
DO NOT phone and complain - Phone calls can be forgotten etc
THEY MUST REPLY TO LETTERS and if they don't you have a copy to produce at court - always send it registered post
One more thing the police officers will have notes in their pocket notebooks
It will say Time - Followed - saw jump red light - stopped - identified driver as - issued tickets.
At court they cannot add bits that isn't in their note book - ie can only say I don't recall the conversation
If you have documented acuratly what was said you have the upper hand......
Trust me on this - I have been both sides of the fence and used it to my own advantage on a number of occasions
To be honest - I think you will have to be really brave to take it to court but if you wait a couple of days and then send a letter complining the Cheif constable will appoint an officer to investigate - he will read your copy of the notes (enclosed with the letter) read th two officers pocket notebooks and then may recomend dropping the case
PROVIDED YOU HAVE EXPLAINED THE SITUATION HONESTLY HERE!!!

this requires a special mentionSilva_B!tch_Owner wrote:IAnyway shall i also mention that this is the 6th, yes 6th time i've been pulled over for somethin or other in the last wait for it.........
3 WEEKS
1. don't mention it - It will be seen in a negative light
2. WHY - they don't pull over people unless there is a reason or you gave them a reason
- Defective light
- Poor driving
- Time of night (if you are out driving at 3am then you are a target because they probably outnumber the cars on the road at that time)
I was stoped last week for the 2nd time in 2 weeks - no issues with it - they wanted to know why I was driving at 1am in the morning - I was the designated driver and dropping of someone who I had spent the evening in a pub with and he was defo not fit to drive.
I was polite and didn't have a problem with being stopped I didn't have any documents with me but they were able to veryify who I was and that I held a driving licence - that the car was insured and MOT'd and they could see the tax disc in the window. Result in my book cos I didn't hav to produce anything at the police station
I did however get told to put a legal Number plate on the car pronto
If my car had been pinched I'd have been happy if they'd stopped someone driving in it....
Bottom line here and I don't want to offend you but they don't target people - I might be wrong here in your case I don't think I am tho but there will be reasons why you have been pulled

So i should write a letter to them explaining what happened and stuff. So i'd send the letter to the police station where they are from i guess?
I swear the law makes more money off the public then anything else. With these fines and crap.
I dunno how i get stopped so much tho, i've been told b4 about twice that i was doin more than 30 mph round a corner, that if i actually did that my car wouldn't still be on the road. It makes me laugh cos they wanted to give me a ticket for speeding, so i said well where's the proof i was doin over 30 mph, soon after they was like well i can give you a ticket for driving without due care, i managed to escape that tho.
Even the other day i went to meet some friends after work at a pub, went home and come back to the pub, parked my car up, nex minute a police car pulls up and 2 officers jump out, and i hear them say my car's number plate so i was like well yeah its my car whats the problem? They was like well we jus recieved a tip off that there's a drug deal goin on, bla bla bla, 5 minutes later a bully van pulls up and about 7 more police jump out and they jus stand there while these other ones are checkin my license and all my other stuff, i was like oh my god man, there jokers i swear.
Maybe i jus have bad luck?

No read it again - write a letter to the Chief Constable - it will be passed to a Superintendant to deal with it - they do not like letters from the general public that indicate their officers have made a mistake or oversteeped the mark as far as enforcing the law goes.....Silva_B!tch_Owner wrote:So i should write a letter to them explaining what happened and stuff. You want your letter to be effective so make sure you follow my guidelines
If you go in with a godamn police/pigs/filth etc waste of taxpayers money shouldn't you be catching real criminals etc etc - forget it it will have no success at all
If you go in with concerned that an error has been made - understand the need to make driving on roads safer with volume of trafic on roads today - felt pressured by the close proximity of the car behind - was aware that it was amber and certainly not red - conversations documented - concerned with the attitude and the officers "should I write myself out a ticket HA HA!" Surely it was more dangerous for the Police car not displaying Warnings Lights etc to follow through it must.......
Do I need to go on?
The law is there for a reason isn't it - are you saying that you should be able to drive how you like an not be worried about prosecution.....Silva_B!tch_Owner wrote:I swear the law makes more money off the public then anything else. With these fines and crap.
You need to slow down....... Calm down and probably learn to keep quiet and not try to justify what is unjustifiable - wouldn't you agreeSilva_B!tch_Owner wrote:I dunno how i get stopped so much tho, i've been told b4 about twice that i was doin more than 30 mph round a corner, that if i actually did that my car wouldn't still be on the road. Nope why bother to go over - just stand at the sidelines and watch!!! no car owner - no document checks required - private land tooSilva_B!tch_Owner wrote:Even the other day i went to meet some friends after work at a pub, went home and come back to the pub, parked my car up, nex minute a police car pulls up and 2 officers jump out, and i hear them say my car's number plate so i was like well yeah its my car whats the problem? It sounds to me like you just like arguing with the police - it's not big or clever and they win everytime unless you are very very very carefull

Re: Goddamn POLICE!!!!!
See I wouldn't agree with something like that, is it a crime to be out at 1am in the morning? I jus don't see how that can be a valid reason for stopping someone, because your out at 1am in the morning.bstardchild wrote:I was stoped last week for the 2nd time in 2 weeks - no issues with it - they wanted to know why I was driving at 1am in the morning - I was the designated driver and dropping of someone who I had spent the evening in a pub with and he was defo not fit to drive.Silva_B!tch_Owner wrote:IAnyway shall i also mention that this is the 6th, yes 6th time i've been pulled over for somethin or other in the last wait for it.........

My friend's been stopped before and they said to him where stopping you because we haven't seen your car in this area before, i mean whats that about?
In my experiences i've had my car keys grabbed from my hands, my mobile phone grabbed while i was looking thru it and one of the officers said "I hope your not trying to record us".
Where do you draw the line?
I mean come on, i don't have anything to hide, if im driving somewhere thats not to much of importance to me and they stop me i dont care because its wasting there time, i have documents to say im allowed to drive and so on.

Re: Goddamn POLICE!!!!!
The police have the power to stop any vehicle at any time in order to astertain who the driver is and what the vehicle is being used for. WHY is that wrong - It means they can stop cars that have been involved in burglaries etc etc etc.Silva_B!tch_Owner wrote:See I wouldn't agree with something like that, is it a crime to be out at 1am in the morning? Stopped.
get out, be polite, listen to what they say, don't be argumentatitive etc
I don't there is no line to drawSilva_B!tch_Owner wrote:Where do you draw the line?
- if I've broken the law and I am caught I shut up and put up
- If i haven't but am being cautioned for it I shut up and put up (I want my case to be stronger and I want to have the upper hand at court, that mean I want to arrouse as litle suspision as possible that my defence will be robust - I listen, don't argue and remember everything and I write it all down afterwards as I have advised
Remember if you argue they just get to pile more weight against you in their pocket books or get to nick you for threatening behaviour - you can't win at the roadside - but you can leave them with an awfull lot of egg on their faces at court!!!
Aren't you contradicting yourself here....... How do they know you have nothing to hide - how do they know you haven't just nicked the car or have a body in the boot or a load of smack in the glove box and you are about to do a deal.......Silva_B!tch_Owner wrote:I mean come on, i don't have anything to hide, if im driving somewhere thats not to much of importance to me and they stop me i dont care because its wasting there time, i have documents to say im allowed to drive and so on.
Read section on Police powers to stop above again.
They have the right and can excersise it whenever they want - accept it

I argue because, i don't like how "some" of them act, so what about when i've had my car keys grabbed outta my hand? How can they be allowed to snatch my keys out of my hands? And my mobile phone too.
Im an aguementive person and after being stopped so many times, its frustrating at times when it keeps happening.
You ever been to London and dealt with any Police down here?
They make ALOT of stuff up i can tell you that now.
